TERMS AND CONDITIONS

By making a booking with Hummingbird Music Pte. Ltd. (“The Company”) via written instruction, payment of deposit, or signing of quotation, The Customer also accepts the following terms and conditions.

1. Cancellation (full or partial)

Cancellations must be made via written notice (with the exception of conditions defined under the Payment clause). Payment for all fees due must be made by Notice Date + 7 days.

For cancellation notices received:

  1. on Event Date + 31 days or earlier, The Customer agrees to pay The Company liquidated damages equivalent to 20% of the price of the cancelled service(s).

  2. from Event Date + 15 to 30 days, The Customer agrees to pay The Company liquidated damages equivalent to 50% of the price of the cancelled service(s).

  3. on Event Date + 14 days or later, The Customer agrees to pay The Company liquidated damages equivalent to 100% of the price of the cancelled service(s).

2. Payment
Unless otherwise agreed upon in writing, all payable fees are due upon set up. Failure to comply will be considered a cancellation and The Company reserves the right to withdraw all services. Liquidated damages charges apply. 

 

3. Permits and Licenses

The application and fees of any required licences and/or permits required for the hired services are not included.

 

4. Definition of Sets
One (1) set is defined as continuous performance of up to Forty-Five (45) minutes, starting from the time the set begins, unless otherwise stated. 


Sets are inclusive of up to One and a half (1.5) hours complimentary waiting time inclusive of sound check, i.e. band reporting time to the start of the first set is One and a half (1.5) hours or less, subject to availability at time of booking. 


Sets may be split into shorter sets provided:

  1. One (1) / Two (2) / Three (3) set bookings are completed within Forty-Five (45) minutes / Two (2) hours / Three (3) hours respectively from the start of the first set.

  2. Provision is made for reasonable amount(s) of rest in between sets.

5. Additional Charges

  1. Waiting time beyond the standard allocation is chargeable at $50 per person per hour, subject to sufficient notice and availability.

  2. If an early sound check is required (earlier in the day or on a separate day), this is chargeable at $120 per person for the first hour and $50 every subsequent hour, subject to sufficient notice and availability.

 

6. Set Up Times

  1. For monitor and/or backline rider provision (i.e. monitoring system and technical equipment required on stage), set up is typically done 2 to 3 hours before the start of the first set (i.e. 30 minutes to 1 hour prior to band arrival for sound check, depending on the extent of the required set up). 

  2. For full sound system hire, set up is typically done 3 to 4 hours before the start of the first set (i.e. 1 to 2 hours prior to band arrival for sound check, depending on the extent of the required set up).

 

7. Background Music (BGM)

  1. For services which include the playing of BGM, said BGM will be played from our existing selection of songs. For song requests outside of our existing library, we will be glad to assist with the playing of song files obtained through legitimate means provided to us in a compatible format (e.g., mp3).

 

8. Force Majeure
If an event of Force Majeure occurs, a Party's contractual obligation affected by such an event shall be suspended during the period of delay caused by the Force Majeure and shall be automatically extended, without penalty, for a period equal to such suspension. The Party claiming Force Majeure shall promptly inform the other Parties in writing and shall furnish sufficient proof of the occurrence and duration of such Force Majeure. The Party claiming Force Majeure shall also use all reasonable endeavours to terminate the Force Majeure. In the event of Force Majeure, the Parties shall immediately consult with each other in order to find an equitable solution and shall use all reasonable endeavours to minimize the consequences of such Force Majeure.

 

9. Replacement
The Company reserves the right to replace hired service(s) / item(s) with that of similar value as determined by The Company in the event that said services(s) / item(s) become unavailable due to factors not within The Company’s direct control.
